OVERVIEW

This website and store are operated by Mirko Moi, trading as “The First 72 Hours Home.” Throughout these Terms, “we,” “us” and “our” refer to Mirko Moi and The First 72 Hours Home.

By visiting this website or purchasing a product, you agree to these Terms of Service. If you do not agree, you should not use the website or purchase our products.

  1. DIGITAL PRODUCTS

The First 72 Hours Home sells downloadable digital resources designed to help family caregivers organize information and prepare for the period following a hospital discharge.

No physical product will be shipped. Product access is normally delivered electronically after successful payment.

You are responsible for providing a valid email address and checking your spam or promotions folders. If you do not receive access to your purchase, contact us at mirko.moi.30@gmail.com.

  1. NOT MEDICAL ADVICE

Our products provide general educational, planning and organizational information only.

They do not provide medical advice, diagnosis, treatment or emergency assistance and are not a substitute for instructions from doctors, nurses, pharmacists or other qualified healthcare professionals.

Always follow the discharge instructions and treatment plan provided by the patient’s healthcare team. Contact a qualified healthcare professional if you have questions about medications, symptoms, treatment or care decisions.

In an emergency, contact your local emergency services immediately.

  1. ORDERS AND PAYMENT

Prices are displayed in the currency made available through our store and Shopify Markets. Applicable taxes may be calculated during checkout.

Payment is processed securely by Shopify and its supported payment providers. We do not directly store complete payment card information.

We reserve the right to refuse or cancel an order when necessary, including in cases of suspected fraud, payment errors, incorrect pricing or unauthorized use of the store.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method.

  1. DIGITAL DELIVERY

Digital products are normally made available immediately after payment through a download link, order confirmation page or email.

Delivery times can occasionally be affected by email providers, technical problems or incorrect customer information. If you experience a problem, contact us and we will help restore access.

  1. PERSONAL-USE LICENCE

When you purchase a digital product, you receive a limited, non-exclusive, non-transferable licence to use it for your personal or household caregiving needs.

You may:

  • Download and save the files for your personal use

  • Print reasonable copies for yourself or the person receiving care

  • Complete the documents digitally or by hand

  • Share completed pages with family members or healthcare professionals involved in the relevant person’s care

You may not:

  • Resell, redistribute or sublicense the files

  • Upload the files to publicly accessible websites, groups or file-sharing services

  • Share blank copies with unrelated third parties

  • Modify the product for resale or commercial distribution

  • Claim the content or design as your own

Purchasing a product does not transfer ownership of its intellectual property.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, all product content, written materials, designs, graphics, branding and downloadable files are owned by or licensed to The First 72 Hours Home and are protected by applicable intellectual property laws.

Unauthorized copying, resale or commercial distribution is prohibited.

  1. REFUNDS AND CANCELLATIONS

Purchases are covered by our published Refund and Cancellation Policy, including our voluntary 14-day satisfaction guarantee.

Because digital products are normally delivered immediately, cancellation before delivery might not be possible. This does not remove the voluntary guarantee or any mandatory consumer rights that apply to you.

  1. ACCURACY OF INFORMATION

We make reasonable efforts to keep the website and product descriptions accurate and current. However, general caregiving information may not apply to every individual situation.

Healthcare practices and recommendations can change. You should always rely on the patient’s current healthcare professionals for situation-specific guidance.

You may not use the website or products:

  • For unlawful or fraudulent purposes

  • To violate intellectual property rights

  • To distribute malicious software

Our store and checkout are powered by Shopify. Payments and other functions may also be provided by third-party services.

Your use of those services may be subject to their own terms and privacy policies. We are not responsible for interruptions or failures caused exclusively by third-party platforms outside our reasonable control.

To the maximum extent permitted by law, the website and digital products are provided on an “as available” basis.

We do not guarantee a particular medical, caregiving, financial or personal outcome from using the products. Results depend on each customer’s circumstances and on following the instructions of qualified professionals.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Mirko Moi and The First 72 Hours Home will not be liable for indirect, incidental or consequential losses resulting from the use or inability to use the website or digital products.

We are not responsible for medical decisions, treatment decisions or emergency actions taken instead of seeking advice from a qualified healthcare professional.

Nothing in these Terms limits liability where doing so would be unlawful.

These Terms are governed by the laws of Italy, without depriving consumers of mandatory protections provided by the laws applicable in their country of residence.
